Terms of Service

1. Acceptance of Terms

By accessing or using the IntelliKran platform and any associated services provided by IntelliCntrl FZE ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These terms apply to all users, including Super Admins, Admins, Distributors, End Users, Observers, and Maintenance Users.

2. Description of Service

IntelliKran is a cloud-based industrial IoT platform for monitoring, managing, and reporting on IKS PLC devices and connected crane and machinery assets. Features include realtime telemetry, fault history, load monitoring, energy analysis, document management, spare parts tracking, access control, automated reporting, and white-label configuration.

3. User Accounts and Access

• You are responsible for maintaining the confidentiality of your login credentials.
• You must not share credentials or permit unauthorised access to your account.
• Role-based access is assigned by your administrator; you may only perform actions permitted by your assigned role.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
• Reverse-engineer, decompile, or extract source code from any part of the platform.
• Introduce malware, viruses, or other harmful software.
• Use the Service in a way that could damage, disable, or impair it, or interfere with other users.
• Scrape or harvest data from the platform without explicit written authorisation.

5. Device Data and Ownership

Telemetry, event logs, and configuration data transmitted by IKS devices remain the property of the device owner or the administrator to whom the device is assigned. We process this data solely to provide and improve the Service and do not claim ownership over it.

6. Intellectual Property

All software, design, trademarks, and content comprising the IntelliKran platform are the exclusive property of IntelliCntrl FZE or its licensors. No part of the Service may be reproduced, distributed, or used without prior written consent except as permitted within the normal use of the Service.

7. Service Availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, infrastructure events, or circumstances beyond our control may cause downtime. We will endeavour to provide advance notice of planned maintenance where possible.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Use of the platform for safety-critical decisions must be supplemented with appropriate engineering judgment and on-site verification.

9. Limitation of Liability

To the maximum extent permitted by applicable law, IntelliCntrl FZE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service, including loss of data, revenue, or profits. Our total aggregate liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at our discretion if you breach these terms, with or without prior notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature survive termination shall continue to apply.

11. Changes to Terms

We reserve the right to modify these terms at any time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of the Service after changes are published constitutes acceptance of the revised terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
